pursuant to art. 8 of the Law of 23 May 1995, n. 70, promulgated by Their Excellencies the Captains Regent of the Republic of San Marino concerning the protection of personal data.
Article. 8 of the Law of 23 May 1995, n. 70, which regulates the computerized collection of personal data for the Republic of San Marino, requires the database manager to inform anyone who is asked to collect personal data on certain information concerning the treatments. The undersigned company Laboratoires Be Well S.r.l., for corporate choice and for greater guarantee for the personal data of customers, has also complied with the Italian legislation on the protection of personal data; this document constitutes compliance with the obligations imposed on database owners (hereinafter: Data Controller) by art. 8 of the Law of 23 May 1995, n. 70, promulgated by the Captains Regent of the Republic of San Marino concerning the protection of personal data (hereinafter the “Code”).
We therefore inform you that your personal data provided by you will be subject, in compliance with the aforementioned legislation and in accordance with the confidentiality obligations that inspire the activity of our Company, of the treatment pursuant to art. 4, paragraph 1, letter a) (the “Treatment”) of the Code.
In particular, we wish to inform you of the following:
1.Finality of treatment:
Laboratoires Be Well srl collects and processes the personal data of the interested parties for the execution of the obligations coming from the contractual relationships established with Laboratoires Be Well srl or for the performance of pre-contractual activities, in particular: customer management; fulfillment of accounting and tax obligations; litigation management; marketing and customer satisfaction surveys. The provision of personal data for these purposes is not mandatory but necessary and the refusal to supply them makes it impossible for Laboratoires Be Well srl to establish and execute the relationships in question.
The data will be processed lawfully, fairly and in accordance with the principle of necessity. The personal data you provide us, voluntarily or automatically through the interactions with the services offered, will be processed, with your consent, for the purpose of transmitting the services requested and creating consumer and user profiles in order to improve the effectiveness of advertising campaigns associated with our services. By registering you will be sent communications emails and / or commercial, promotional and advertising information regarding partners selected by us.
Communication to third parties and diffusion:
The achievement of the aforementioned purposes may also be achieved by transmitting and communicating data to third parties, meaning those third parties authorized to the related data processing, as they are charged with performing or providing specific services strictly functional to the execution of the contractual relationship, such as: banks and credit institutions; companies responsible for packaging, shipping and delivery of goods; companies specializing in customer support and for customer satisfaction surveys; professionals, external debt collection companies. The names and addresses of these subjects are available at the request of the interested parties.
Diffusion and data transfer abroad:
The personal data of the interested party will never be diffused in any way. The data is stored in the Republic of San Marino and can be communicated to companies or companies based in Italy only when strictly necessary for the pursuit of the purposes indicated in point 1, letter a) and, in the presence of consent, letter. b).
The processing of the data of the interested party may also concern data of a sensitive nature, pursuant to art. 4, paragraph 1, letter d) (“sensitive data”) and article 26 (“Guarantees for sensitive data”) of the Code (ie those data “… capable of revealing racial and ethnic origin, religious beliefs, philosophical or other, political opinions, subscribing to political groups, trade unions, associations or organizations of a religious, philosophical, political or trade union nature, as well as personal data capable of revealing the state of health and sexual life “).
Laboratoires Be Well srl processes the personal data of the interested parties in a lawful and correct manner, in accordance with the regulatory provisions dictated by the San Marino and Italian regulations, in order to ensure their confidentiality and security. The processing is carried out using manual, IT and telematic tools, with organizational methods and logic strictly related to the purposes indicated.
Rights of the interested party:
In relation to the processing of personal data, the data subject is entitled to the rights referred to in article 7 of the Code, among which, we remind you of the rights to: obtain confirmation of the existence or not of personal data concerning him, even if not yet registered, and their communication in an intelligible form; obtain the indication: of the origin of the personal data, of the purposes and methods of the processing, applied logic in the case of processing carried out with the aid of electronic instruments, of the identification details of the Owner, of the Managers and of the designated representative, of the subjects or of the categories of subjects to whom the personal data can be communicated or who can learn about them as appointed representative in the territory of the Italian State and in the Republic of San Marino, of Managers or Persons in charge; obtain: updating, rectification or, when interested, integration of data, deletion, transformation into anonymous form or blocking of data processed in violation of the law, including data that does not need to be stored in in relation to the purposes for which the data were collected or subsequently processed, the attestation that the operations referred to in letters a) and b) have been brought to the attention, also with regard to their content, of those to whom the data are been communicated or diffused, except in the case in which such fulfillment proves impossible or involves a use of means manifestly disproportionate with respect to the protected right; object: for legitimate reasons, to the processing of personal data concerning him / her, even if pertinent to the purpose of collection, to the processing of personal data concerning him / her for the purpose of sending advertising materials or direct sales or for carrying out market research or commercial communication.
At any time you can contact the data controller to exercise the rights provided by the art. 7 of the Code or to modify the consent given in the telephone information, writing to the attention of the Data Processor, or via e-mail to firstname.lastname@example.org. Furthermore the articles 10 and 11 of the Law of 23 May 1995, n. 70, recognize certain rights to the interested party, which we invite you to carefully consider: art. 10. Anyone, on the basis of a specific request in legal paper signed and addressed to the Guarantor, can ascertain whether the databases registered in the repertoire referred to in Article 6 or those managed by the State and public bodies have collected or processed named data which concern yourself. art. 11. Everyone can obtain a copy of the data and information that concern him personally under the following conditions: a) that the application, in legal paper, is signed by the owner himself or by his legal representative and is in any case accompanied by the details of a document of valid personal identity; b) that the information collected is not protected by law from absolute secrecy. The right of access to health information can be exercised only through an employed doctor or an agreement with the Institute for Social Security, whose name must be indicated in the application; it is up to the doctor to communicate all or only part of the information to the patient.
